Customer Agreement and Personal Guarantee
CUSTOMER AGREEMENT:
The Customer warrants that the information submitted is true. The Customer agrees to pay all invoices in accordance with the terms of the sale. A SERVICE CHARGE of one and one half percent (1 1/2%) per month [ANNUAL PERCENTAGE RATE of eighteen percent (18%)] will be assessed on any amount not paid in full within thirty (30) days from the billing date. In the event Triangle Food Products Corporation is required to place the collection of any amount due hereunder in the hands of an attorney for collection, Customer agrees to pay all charges, expenses, court costs and reasonable attorneys fees attributable to collection. A $25 fee will be charged for any returned check.
PERSONAL GUARANTEE:
The undersigned, having a financial interest and benefiting from the transactions contemplated by this application, and as an inducement to Triangle Food Products Corporation to extend credit to, sell and ship goods on credit terms, or to otherwise deal with Customer, I hereby personally guaranty the due and punctual performance of all obligations and payment of all sums due from Customer to Triangle Food Products Corporation. I further hereby waive notice of default and the benefits of N.C. Gen. Stat. § 26-7 through 26-9, inclusive. This guaranty shall continue until receipt by Triangle Food Products Corporation of written notice of cancellation from me.
